This guide is about why divorces in states such as New Jersey, cost so much to complete in many cases. In short, freedom has a price.
Just because you are ready to settle, does not mean your spouse is
People often come into my office and indicate that they have a "simple" divorce and it will be quick. I ask why and the usual answer is either, I will agree to divorce or she will agree to divorce. Agreeing to divorce, believe it or not, is the easiest part. What is the hardest is child custody, child support, alimony, division of assets and so forth. While you may think you have offered something equitable, your spouse may want more and then want more again. Nothing is easy until there is a signed deal, period.
Some people use divorce lawyers as a way to "get even" with their spouse regardless of the cost
If one said has more money, or access to the marital funds, one party may keep spending and spending in order to drag the case on and to hurt you financially, emotionally and so forth.
Why can't the Judge divorce us and then we can figure out the rest later?
Only in very few cases will the presiding family court Judge in your county allow parties to burificate the divorce and the remaining issues. In the majority of cases, all issues have to be dealt with before the Judge divorces the parties. Again, spouses who know this, may keep pressing issues to delay the divorce.
Why is my bill so high?
Everytime a lawyer receives a call, a letter, goes to court, writes papers, it is for you and the defense or on the offensive for your case. When an attorney is dealing with someone that dpes not truly want to settle or does not want to settle on your terms, it will cost a considerable amount of money. It is always best to try and narrow the issues you do not agree on if you cannot settle so that your trial will not cost you everything you have.
