Late Plan payments in your Chapter 13 bankruptcy case

I have just answered my tenth question about this, today. The questions all ask, "can I make a late payment," or "what will happen if my payment is late," or "can I skip a month?"

The answer to all this is real simple: Don't be late or miss a payment without working something out between you and the bankruptcy trustee. A one time late payment will not get much attention, but continued late or missing payments will trigger a motion by the trustee to dismiss your case!

If the case is dismissed, all your creditors can start calling, again.

If you can't maintain your Plan payments, call your lawyer and ask to file a motion to modify your Chapter 13 Plan. This gives you some control overe the process. If you simply miss or skip payments, you give the control over to others.
