Is a Day Care Center Responsible for Paying the Medical Bills from an Injury at the Facility?

Day care centers have a duty to provide reasonable supervision and a safe play / educational enviroment. When a child is injured at a day care center, parents are faced with the challenges and issues associated with medial care and medical bills for the child. Is a day care center responsible or liable for the medical bills associated with a day care center injury? In most States, a day care center is responsible for medical bills associated with a day care center injury if it can be proved that the injuries resulted from the negligence, carelessness, or fault of the day care center and its staff. Some day care centers carry a special type of insurance called Med Pay / Medical Payment insurance. While a day care center is not legally liable just because an injury takes place at a day care center, Med Pay insurance policies often times pay medical bills regardless of fault as long as the injury takes place at the day care center. Like other types of negligence cases, the following elements must be proved:

  1. Duty; 2. Breach of Duty; 3. Causation; and 4. Damages.

Medical bills are just one issue faced by parents dealing with the aftermath of a day care center injury. Becasue of the complexity of these cases, a parent should contact a Personal Injury Attorney for advice, consultation, and legal representation.
