I owe my parents money, do I have to include them in my bankruptcy?
.One of the questions I ask every client who comes to me for a bankruptcy consultation is "do you owe any money to friends or family?" About half of the time the answer to the question is yes; when the answer is yes, the response that always follows is "but I'm not going to incude that in my bankruptcy." I then proceed to explain to my ciient that the bankruptcy requires you to list everyone you owe money to, even friends or family, under penalty of perjury. Listing your friend or family member as a creditor in your bankruptcy has no consequence to them, other than that the debt will normally be discharged. You can of course choose to repay the debt at a later time, if you wish.
