How to Win Your Asylum Case

Asylum Guide by former INS Attorney Carl Shusterman (1976-82). How you can win your asylum case before the USCIS or in Immigration Court.

To be eligible for asylum in the US, you must have been persecuted or have a "well-founded fear of persecution" in your country based on one of the following 5 grounds:

  1. Political Opinion -

  2. Religious Beliefs -

  3. Race -

  4. Nationality -

  5. Social Group -

Examples of Social Groups include:

Generally, you must apply for asylum within your 1st year in the US, but there are numerous exceptions to this rule -

You cannot qualify for asylum in the US if you were "firm resettled" in a 3rd country -

Even if you are not qualified for asylum, you may be eligible for the following benefits:
