How to file I-130 Petition Unmarried Child under age 21 of US Citizen Father
Complete form I-130Fill in EVERY question listed in petition. If a question does not apply to you, make sure you fill in N/A. Make sure you provide beneficiary's I-94 Number and Alien number if available even if beneficiary is out of status.
Provide documentsYou will need to provide the following documents:
Father's proof of citizenship (for example birth certificate or naturalization certificate)
child's birth certificate showing father's name along with marriage certificate.
If child was born out of wedlock, and the child was not legitimated before reaching 18 years old, you must file your petition with copies of evidence that a bona fide parent-child relationship existed between the father and the child before the child reached 21 years. This may include evidence that the father lived with the child, supported him or her, or otherwise showed continuing parental interest in the child's welfare.
Any documents not originally written in English must be translated in English. Translator must certify under oath that they are well versed in both English and the language of origin. A copy of the foreign document must be submitted with the translation.
