Anytime you are charged with a crime, your first and best step should be to call an attorney. A local attorney can help you understand how your local court and prosecutors function.
Get a Hearing Request Form
Department of Licensing requires that you make an affirmative request for your DOL hearing (and payment of $200, unless they qualify you as indigent). You must do this within 20 days of the date of arrest.
Once a hearing has been requested, DOL should send you or your attorney the DOL Exhibits, as well as a cover letter with the hearing information. It is important to review the discovery and note which officer's were involved.
Subpoena the Officers
This involves several small steps: (1) prepare a subpoena request, (2) send it to the hearing examiner to be signed, and (3) serve it on the officer (or their office) more than 10 days prior to the hearing. It is important to obtain a "proof of service."
DOL accepts motions under 20 pages without prior authorization. A good DOL hearing starts with the hearing officer being prepped on the issues.
Go through the hearing
DOL hearings in Washington are notoriously tough. Be methodical and concentrate on the best issues.
Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals.
