No Attorney's Fees Unless You Obtain CompensationSince those suffering from 9/11-related conditions are already dealing with mounting medical expenses, lost wages and other costs, they may be reluctant to each out to a lawyer because of a concern about attorney's fees. However, most 9/11 attorneys won't charge you anything in attorney's fees unless they obtain compensation for you from the VCF.
The Law Caps Attorney's Fees at 10% of Any Compensation RecoveredIf your lawyer does get you compensation, the law caps the amount of attorney's fees they can receive out of your award. Under the Zadroga Act, your 9/11 attorney cannot charge you more than 10% of the amount of your VCF award.
Under VCF regulations, your attorneys may also charge you for expenses that are routinely incurred in the course of providing legal services, but those expenses and attorney's fees must not exceed the 10% cap.
Reimbursement over the 10% for Some Expenses Incurred by Your 9/11 AttorneyNotwithstanding the 10% cap on attorney's fees and costs, the VCF will allow your attorney to charge you for non-routine expenses in excess of the 10% limitation if the expense is considered to be outside of the normal expenses incurred while submitting a claim to the VCF.
One example of this type of expense is to obtain copies of medical records in order to:
o Demonstrate the severity of an eligible injury and/or whether you disabled (i.e., unable to work at full capacity) because of the eligible injury
o Demonstrate the impact of the injury has had on you - including records of medical treatments, prognosis, and limitations on your activities - for purposes of determining non-economic loss
