Guidelines for an OC DUI Checkpoint

There are strict and legal guidelines that authorities must follow when conducting a sobriety checkpoint in Orange County. These guidelines must be performed in a neutral, mathematical formula so that each check point is conducted lawfully.

Before conducting the checkpoint, guidelines include:

  • choosing a time, duration and location where there is a high level of alcohol-related arrests
  • announcing the DUI checkpoint before it occurs
  • making sure there is proper lighting, warning signs and signals and clearly identifiable vehicles and officers

During an OC DUI Checkpoints, guidelines include:

  • sticking to a formula such as stopping every driver or every second, third or fourth driver
  • keeping the length of detention of each motorist minimal
  • making sure the check is not intrusive
