Grandparent Guardianship of Minor Child
Grandparents are raising their grandchildren due to a variety of circumstances but a high percentage raise their grandchildren due to drug addiction. Guardianship is often necessary for the Grandparents to make decisions for these children and to receive benefits on behalf of the kids.
Parental Drug Addiction Resultsin Grandparents' GuardianshipGrandparents raised their children and are now raising their grandchildren due to the explosion of drug addiction. Often the choice is a Guardianship or DHS custody of their grandchildren. Grandparents are burdened with retirement income and growing, young children. Often Grandparents are forced to go back to work to provide for their grand-kids.
The beautiful thing about Grandparents' Guardianship is that I have never met grandparents that would change their decision to take care of their grandchildren. They provide their grandchildren with a home, food, medical care, stability and most of all-Love. Often these children feel abandoned by their parents and are emotionally scarred by what they have been through. These children may need counseling and tutoring to resume a natural childhood.
Guardianship Are Not PermanentThe majority of Guardianship Orders are not permanent. Parents addicted to drugs can usually terminate the guardianship if they can prove that they haven't used drugs for a year, a stable home and steady income over a period of time. When the parents file to terminate the guardianship, the Grandparents are usually heartbroken because they have been here before with their son/daughter before and don't want their grandchildren to go through the heartbreak again. Unfortunately due to the statutes of the State of Oklahoma the Judges have no choice but to terminate the Guardianship if the parents meet the Court's requirements. Legal fees can be very high for grandparents to oppose the termination proceedings but most feel that they have no choice but to do so.
This maybe tumultuous times for these children. Grandparents need to remember that they can apply for grandparent visitation if the Guardianship terminates so they can make sure to stay in their grand-kids' lives and continue to provide them with their love.
