Gathering Evidence in Family Law Cases in Florida
There are discovery tools available to individuals in family law cases in Florida. The most commonly used are a "Request to Produce" and "Interrogatories". You can also subpoena documents from third parties and take depositions to help you gather the evidence you need to support your position.
Request to ProduceFamily Law Rules of Procedure Rule 12.351 permits you to request documents and things from the opposing party that may be relevant to your case. For example, you can request bank statements, paycheck stubs, and tax returns to help calculate an individual's actual income for child support purposes.
InterrogatoriesFamily Law Rules of Procedure Rule 12.340(b) permits you to ask up to ten (10) additional questions (beyond the standard/pre-defined interrogatories) , including sub-parts, that must be answered by the opposing party under oath.
