First Amendment Rights
This is absolutely a violation of the First Amendment! Ledward has the right to play his guitar at the airport. The law that DOT is citing was enacted to prohibit groups from soliciting money at the airport. The State "may place reasonable time, place and manner restrictions". on such commercial act
First Amendment Right to play music at the airportNon-commercial speech cannot be outlawed. The State of Hawai'i Department of Transportation cannot enforce this provision of the law when Mr. Kaapana is merely playing his guitar.
This free speech must be protected!The State has an absolute right to regulate commercial activity. Not First Amendment speech!
