California Realignment of Felony Sentencing (818) 590-8294
In light of the state's budge crisis, Governor Brown signed AB109 ("Realignment") to reduce the over population in State Prison. This is the biggest change since the 3 strikes law. Effective October 1, 2011, a Defendant sentenced to a felony prison sentence that is non-serious, nonviolent, and non-registerable sex offense (the 3N rule), the Defendant will be serving his prison sentence in county jail. Sheriff has wide discretion for early release and home monitoring to satisfy the prison sentence. It is anticipated for the first six months, the Sheriff's will have room to hold every sentenced prisoner, and perhaps at the cost of early release of misdemeanor cases. There are other changes such as a Defendant serving his prison sentence in County, will not be on Parole when he gets out and will be supervised by Probation under this new system of "Post-Release Community Supervision."
