Elephant Guide to a Website Development Agreement: Second Byte
Price of Services, And severability of services
PriceThe prices in a Website Development Agreement can be set by Project, by page, or by hour. If it is set by page or by hour it should have a clause in the contract when the payments to Developer stop if the "by page" or "by hour" is turned over to the client (or their employees, or outsourced by them). Price should make clear that it is a project price, not a licensing deal or an ongoing charge deal.
SeverabilitySeverability - the prices and project expectations have to be set at the inception. That way when disagreements (or just a new Website-Developer employee client is not happy about) the price reflects the new reality. The components (original design, ongoing changes, future maintenance) have to be specified with evenhandedness and clarity. "Maintenance" should have its own paragraph, including definitions.
