Domestic Assault requires a relationship.Juvenile and Domestic Court hears these charges. If the assault is husband and wife or children or former spouse of baby mother or father and some others then it qualifies as a domestic assault.
The person calling the police could get arrested.The police will come and investigate. They will arrest the primary aggressor and maybe both. A temporary protective order will be issued for 72 hours. That means the parties can have not contact with each other or through other people for that time.
The PenalityThe Juvenile and Domestic Court has many options from jail time to dismissal. There is a one time first offender program which may include anger management and good behavior and the charge will be dismissed after two years. More serious assaults can result in jail time. A third conviction is a felony.
