What Rights are Protected under Article 36 of the VCCR?
Foreign nationals detained in a foreign country are entitled to notification without delay that they may contact their consular officials if they choose. Certain countries have agreements that provide for mandatory notice whenever a foreign national is arrested or detained.
What are the Advantages of Consular Notification?
There are many possible benefits to consular notice. A country's consulate represents and protects the interests of its citizens in a foreign host country. It can provide information to an arrestee or detainee and his or her family about the legal system of the host country, locate legal assistance for defending someone against criminal or immigration charges, contact family outside the U.S., locate helpful evidence to assist in a person's defense, and provide for material assistance to persons who are being removed.
