Cancellation of Removal Immigration Court

TEN YEAR CANCELLATION WORKSHEET / CHECKLIST

Required Forms

File with Court & DHS:

· Original Cancellation of Removal Application Form (EOIR-42B) (see attached)

· Fee of $100

· Copy of Biographic Information Form (G-325A) (see attached)

Proof that you have lived in the United States continuously for ten years

· Rent receipts

· Tax returns

· Pay stubs from work

· Children's birth certificates

· Deed to house

· Medical records

· School records

· Baptism certificate

· Bank statements

· Driver’s license

· Any Letters address to you, with date and envelope

Letters/Affidavit your employer(s), family members, neighbors, landlord, or someone else who has lived with you or seen you a lot in all or part of the 10 years)

List of Witnesses (who can testify about knowing you 10 years)

· Name of Witness

· Relation

· Date of Birth

· Address

· Immigration Status

Proof of Good Moral Character:

Letters from friends, coworkers, priest or other religious leader, proof of community service or other volunteer activities to help others

Employment Records

· Tax returns (10 years)

· Pay stubs or social security records

· Letter from employers

Rehabilitation (if any criminal problems):

· Certificate of completion

· Proof of participation in programs

· Letter from (probation officer? guard?)

Hardship

Family ties in U.S., hardship on you and family if removed from the U.S.:

· Children’s birth certificates

· Marriage license

· Medical records/Doctor’s letter (if you or someone you care for has a medical problem)

Proof of special hardship (illness of family member):

· Proof of relation (birth certificate, marriage certificate or other)

· Medical records/Doctor’s letter (if you or someone you care for has a medical problem)

· Letter from school counselor, psychologist, doctor, nurse of illness

· Letter from anyone who knows how hard it will be on you and/or your child to return to your home country

To show emotional hardship:

· Affidavits from people who would be affected by your removal

· Family photographs, especially with you in them, that show how close your family is.
