Can I sue if my baby has cerebral palsy?
Cerebral palsy (“CP”) is a medical condition which affects a person’s ability to move around and keep their balance.
According to information from the Centers for Disease Control and Prevention (“CDC”), CP is the most common motor disability for children.
In addition, the condition occurs in about 1 out of every 323 children.
CAN I SUE IF MY BABY HAS CEREBRAL PALSY IN MARYLAND?
To the question of can I sue if my baby has cerebral palsy in Maryland the answer is yes, you can.
Because birth injury cases are very complex, these are not the types of cases that you want to handle on your own, in my opinion.

HOW CAN CEREBRAL PALSY HAPPEN DURING BIRTH?
One of the main ways we see cerebral palsy/brain injuries occur is when a child is in distress during a vaginal delivery.
The fetal heart monitor might show that the child is not tolerating a vaginal delivery well, and/or the baby may have meconium stained fluid.
When there is strong evidence that a baby may not be handling a vaginal delivery well doctors must look to help the baby.
This can be in the form of performing an emergency C-section as soon as possible.
If the baby is in distress for too long then a lack of oxygen can take place.
Once there is a lack of oxygen present then there is always a serious risk of damage to the baby’s brain, which can lead to a cerebral palsy diagnosis in the future.
