Can I receive Ohio Work Comp Permanent Total Disability, if I am on SSD ?

If you receive Social Security Disability or Ohio Public Employee Retirement System Disability, you’re still entitled to seek Ohio Workers’ Compensation Permanent Total Disability (PTD) Compensation. For more information, read on . . . Under current law, there are offsets against certain disability awards received.

Ohio PTD is reduced, under certain circumstances, if you are on SSD and you are under 65 years of age. Once you reach 65, there is no reduction from Ohio Work Comp PTD. However, you should discuss this with a Board Certified Ohio Workers’ Compensation Specialist.

SSD – there is NO reduction in SSD monthly payments if you are receiving Ohio PTD compensation.

OPERS – there is no reduction in Ohio PTD or from OPERS disability compensation.

As always, you need to discuss your particular situation with a Board Certified Ohio Workers’ Compensation Specialist.

Don’t decide what you are or are not entitled to without the expert advice of an Ohio Work Comp Specialist regarding your Ohio Workers’ Compensation claim.
