How to Avoid Problems in Subdivision, Land Development and Zoning
Checking the RequirementsDetermining the requirements of the applicable zoning, subdivision and land development, and other ordinances is one part of that. It is important to locate, review, and understand the regulations that apply to your project.
Interaction with the MunicipalityIn most cases, it is helpful to consult with the municipality during the early stages of the process. The municipality deals with their specific codes on a regular basis. Sometimes the municipality's interpretation of the code may differ from yours. But it is helpful to know how they interpret and/or apply various code provisions that may be applicable to your project.
Engaging ConsultantsIn many cases, it is advisable to engage a professional engineer and/or legal counsel and other consultants depending on the circumstances. If a zoning variance(s), special exception, or conditional use is required, a formal presentation of testimony and other evidence is usually necessary.
Avoid Unnecessary CostsProceeding without understanding the process or without proper planning and analysis can lead to unnecessary costs, lost time and other problems.
