Attached Tag Not Assigned - Criminal Traffic Violation

Florida Statute 320.261 states that "[a]nyone who knowingly attaches to any motor vehicle or mobile home any registration license plate, or who knowingly attaches any validation sticker or mobile home sticker to a registration license plate, which plate or sticker was not issued and assigned or lawfully transferred to such vehicle, is guilty of a misdemeanor of the second degree..."

As a second degree misdemeanor, this offense is punishable by up to 60 days in the County Jail. However, jail time is rare for first time offenders, but the likelihood of fine (up to $500.00) and probation (up to six months) does exist.

Due to this offense being a misdemeanor, it is important that you have an attorney represent you on this charge. The State has a tough burden in these cases unless the officer witnessed you actually place the tag on the vehicle or you admitted to placing the tag on the vehicle.
