Assault Family Violence, Strangulation Travis and Williamson Counties, Texas

There is a new prosecution tool for enhancing Assault Family Violence Misdemeanor charges in Austin, Travis and Williamson County Texas cases. Normally, if you have an argument with your spouse, boyfriend, girlfriend, significant other or even your date and it turns physical, you will be arrested and charged with a domestic violence charge or assault family violence. This is a class A misdemeanor that carries a possible jail sentence of up to one year, and up to a ten thousand dollar fine. As if this was not enough of a nightmare for a minor altercation blown completely out of proportion, it CAN get worse. If there is any hint or suggestion that either one parties' hands were near the other's nose, neck or throat, that allegation alone is sufficient to bump the charge to a felony. This turns a 1st offense into a life changing, career ruining FELONY charge that carries up to Ten years in Prison. There is never a good reason to put your hands on someone during an argument. It is obviously the wrong time and solution for many reasons, not the least of which is once law enforcement is involved it can escalate beyond what most people imagine Very quickly. It takes an excellent criminal defense attorney to get the best result and force the prosecutor to dismiss Assault charges.
