Arrested in Portland for Criminal Sexual Solicitation - What Happens Now?
If you have been arrested in Portland, OR for a prostitution related misdemeanor, you may be eligible for Multnomah County's Community Court program. This program allows you to earn a dismissal of the charges and, if you qualify, have the record expunged.
The Community Court ProgramIn short, the program requires that you plead guilty to the charge. The case is then postponed for about 6 months. If you complete the conditions within these 6 months, then the charge is dismissed. However, if the conditions are not completed, then the judge enters a conviction and you are sentenced to jail time.
The conditions are (1) complete a one day "Johns" class. The cost is around $1,000. (2) don't get arrested or convicted during the 6 month period.
If you live out of state, I can usually have your some or all of your appearances in court waived.
This program is only available for people charged with a prostitution related misdemeanor. If you have been charged with a felony, this is not an option for you.
The Dismissal of ChargesOnce your case has been dismissed, there are still records of the arrest and court proceedings that we will need to have expunged. If you otherwise qualify, we can begin the expungement process as soon as your case is dismissed.
Once the record is expunged, you may swear under oath that you have never been arrested. At this point, all official records are sealed. This includes the police reports, District Attorney file, court records, and Oregon State Police records. Oregon State Police then provides this information to FBI so that the record is removed from the FBI database as well.
