Alternatives to H-1B
With the H-1B cap, it is becoming more difficult to get the right employees into companies. Below you will find a couple of alternatives to the H-1B visa.
TN VisaThe TN visa was created under the NAFTA agreement. It allows for professionals from Mexico and Canada to come to the United States and work. This is a great alternative because there is no cap on the amount of visas that can be issued each year and the visa can be renewed as many times as you would like. O-1 VisaThe O-1 visa is available to persons with extraordinary abilities in the arts and sciences. While it may sound like it has the same criteria as an EB-1 visa, the threshold is lower for obtaining this visa than the EB-1. It is also an introductory visa to an EB-1.
E-2 investor visaAn individual who cannot obtain an H-1B may also want to consider an E-2 investor visa. To obtain an E-2 your country must be a signatory to a treaty with the United States. You must invest "substantial" capital in a business and have controlling ownership. There is also no limit on the amount of renewals.
