Alcohol, Marijuana and Cigarettes - Suggested Terms for a Parenting Plan
Suggested terms for a parenting plan when one or both parents smokes cigarettes, uses marijuana (hopefully legally) and drinks alcohol (perhaps a bit too much).
Alcohol UseNeither parent shall consume alcohol to the point of impairment while exercising parenting time.
Marijuana Use[a] Any medical marijuana use will not take place with the knowledge of or in the presence of a child.
[b] A parent who is authorized pursuant to relevant State law to use medical marijuana will, nevertheless, abstain from using medical marijuana beginning twenty-four (24) hours before his/her parenting time begins and at all times during his/her parenting time, regardless of whether the children are in his/her sole care (for example, despite the fact that there may be another adult in the home).
Cigarette Use[a] Neither parent shall smoke cigarettes in an enclosed area (i.e. car, closed room) if a child is present.
[b] Neither parent shall smoke indoors if a child is present.
