California Labor Code sec. 4662 lists certain circumstances in which a person can be considered to conclusively have 100% Whole Person Impairment. This guide lists those circumstances from the Labor Code.
CA Labor Code sec. 4662 (a):
Loss of both eyes or the sight thereof.
CA Labor Code sec. 4662 (b):
Loss of both hands or the use thereof.
CA Labor Code sec. 4662 (c):
An injury resulting in a practically total paralysis.
CA Labor Code sec. 4662 (d):
An injury to the brain resulting in incurable mental incapacity or insanity.
The final line of the code section states that:
In all other cases, permanent total disability shall be determined in accordance with the fact.
