$2.5 Million Awarded in Montgomery County Medical Malpractice Case

A Montgomery County Circuit Court jury awarded $2.5 million to the family of a man who died after his doctor failed to notice and treat the signs of hemorrhagic shock. The Montgomery County man fell and fractured his pelvis. He died two days later in Montgomery County General Hospital. The jury found that the man’s primary care physician failed to identify and treat internal bleeding resulting from the accident. The internal bleeding led to multiple organ failure and a lack of oxygen and nutrients necessary for cellular function.

Attorneys for the plaintiff argued that the only things needed to save his life were two liters of saline solution and two units of red blood cells. The deceased man’s attorneys argued that the doctor should have noticed that the plaintiff had gone into kidney failure because he had not urinated for 24 hours and had low blood pressure, a rapid heartbeat and a change in mental status. Further, nurses alerted the doctor to the plaintiff’s lack of urine and his need for more fluids, but the doctor did not treat him adequately for those problems.

The Montgomery County jury made up of eight men returned with the $2.5 verdict after ten hours of deliberations. The trial lasted six days. The estate of the plaintiff was awarded $1 million in non-economic damages for pain and suffering up to the time of his death; the jury also awarded $1 million in non-economic damages to the plaintiff’s wife and $250,000 to each child. Because of the state’s cap on non-economic damages the verdict will likely be reduced to $812,500.
