"Will my FDCPA lawsuit against a debt collector settle or will it go to trial?"

This is a wonderful question.

Very few cases actually go to trial for a few reasons such as:

  1. The fact that most civil cases settle.

  2. Fee shifting can take place. This means the debt collector can be forced to pay your attorney's fees.

  3. If there are good lawyers on both sides, they know the value of the case.

  4. Ultimately, both sides shy away from the risk of trial if there is a good and fair offer on the table to resolve the case.
