i worked at a car dealer in md. i was terminated by the gm for being " a cancer " . I was never late,came in on my days off,stayed late. made lots of money for the dealer,never had a customer complaint as with other salesmen.I didnt want to copy and paste fraud docs, run credit w/o permission. I dont gamble,drink or do drugs on or off the clock. The things I mentioned above goes on everyday at this car dealership and this is also done by the manager himself during working hours. The owner and GM know that this goes on. I was one day because I had personal reasons and this was ok'd by the manager,but he didnt let the GM know that I would be gone for 4hrs. when I returned i was fired by the GM. I sent emails to them both 3weeks before I was to take that 4hrs off. do I have a case
I am sorry that you are going through this difficult situation. Most employment law issues require a careful analysis of all the detais, so getting specific advice on this forum is difficult. However, I can share that employers generally have broad discretion to manage their work force. Because Maryland is an "employment at will" state, an employer can terminate your employment for nearly any reason. For example, your employer could terminate you because (i) it does not like your attitude, (ii) you make a single, minor mistake on the job, (iii) you failed to follow a rule, or (iv) you came to work five minutes late. In other words, you can be fired for nearly any reason that your employer wants to fire you.
However, there are several important exceptions. First, your employer may not be able to fire you if you have an employment contract that limits the reasons for termination. Second, you cannot be fired for discriminatory reasons, such as your age, gender, race, national origin, color, religion or disability. Third, you cannot be fired for filing a workers compensation claim, or for demanding proper wages or overtime pay, or for taking time off that is protected under the Family and Medical Leave Act. Fourth, you cannot be fired if your termination would be contrary to public policy, such as if you are a whistleblower or are engaging in conduct that is protected by law.
If you termination did not fall into one of those exceptions, then there is likely not much that you can do about your termination. I wish that I had better news for you. Good luck.
