My father has been renting a 3rd floor 1 bedroom a apartment which has no kitchen. Recently his apartment had to be inspected where the inspector told him it was illegal for him to live in a residence with no kitchen. The landlord was given a ticket eventually. At this point my father is currently being forced to find another place to stay due to this situation.
Based on the landlord renting this apartment to my father and it being illegal being it has no kitchen, is he able to get all of his rent that he paid prior to this incident, and also does he have to keep on paying while looking for a new residence, being that this apartment should not have been rented to him in the first place?
A landlord who rents out a unit that is subsequently determined to be illegal must pay the tenant occupying the unit 6 months’ rent before the tenant has to move out. That is the most your father could recoup.
