My roommate and I got charged a $300 "security deposit" for "general cleaning" because the landlord has told my roommate not to smoke marijuana in the apartment and feels that he needs to wash and repaint his room again because it, which is why he asked for the $300 (smoking was never mentioned in the lease, nor was a security deposit ever requested or any procedure identified that would state that cleaning fees can be taken; we have lived in this apartment for 2.5 years). I spoke to another lawyer who told me that this fee was illegal and should not have been requested from us. We never received any information regarding what bank the deposit is being held at and have reason to believe the landlord knows what he did is illegal and has pocketed the money with no intention of returning it. Thus, to get the money back, my roommate would like to deduct it from our rent. Is this an appropriate course of action? The landlord has also never made any necessary repairs to our bathroom at all although an inspector from the city came in and notified the landlord of necessary repairs, which he has not responded to whatsoever.
No, you can't withhold rent for the $300.
Call the city again about the repairs.
