I got married in April of 2012 but the paperwork was never filed and due to his infidelity and physical abuse he and I were done 28 days later. I had him stayed for the abuse and a restraining order. He never actually was placed on my lease or anything.
Yes, you are married. The "paperwork" is filed by the officiant. You may be eligible for a summary dissolution.

I concur with my colleagues. Although a Summary Dissolution is not really a viable option when you have a restraining order.
