I live in MN, and am wondering about an adoption situation. My brother lives in ND, and he is the legal father of a 1 year old baby girl. Her mother just died, drug overdose. The biological father has not come forward to claim any rights or acknowledge the baby. There are arrest warrants out for him, and he is being investigated by the drug task force in relation with the mothers death. Would my spouse and I be able to adopt her, and what kind of rights could the possible biological father have?
FYI in ND, there were warrants issued on 1-10-17 and 2 issued on 1-20-17. Bio dad has been in jail before and is facing more felony charges for probation violation. My brother does have the baby's half sister, who is his biological daughter. The baby and other child did test positive for meth and Marijuana
Yes. You should be able to complete an adoption. Both your brother and the biological father may need to agree to voluntarily terminate their parental rights. Contact a family law attorney.
