I was with a friend who was shoplifting and she was caught. We both were charged with retail theft. I was giving the opportunity to take a class to have it expunged, but I was told it can take a few weeks. I was offered a job where I need to go get finger printed for a background check. I had a caseworker for a program who wanted to know if I had a criminal background, I told her yes and she ran my ssn but she said nothing was found and that was before my class.
Summary offenses do come up in background checks. Further, retail theft is a serious offense in Pennsylvania because there are escalating penalties for subsequent offenses. If the offense didn't come up in the background check, it may be a delay in the background service they are using or some other reason. Good Luck.

An individual must file a petition to expunge a criminal conviction and/or arrest in Pennsylvania. The Arresting Officer and victim may agree to dismiss a retail theft charge after a defendant completes a particular program. As a result, the defendant would benefit by not having a conviction to retail theft. However, the defendant's record will show that he/she were arrested unless the record of arrest is expunged by way of a petition.
It will come up in a backround check, Sometimes, you might get lucky, and it won't come up. Possibly, the charge has not gone through yet. Take the class and have it expunged. It will come up soon. I would NOT take any chances. Retail Theft seems minor, but not to many companies,so please get it expunged,since you have the opportunity. It will then take time to go through the system to be expunged. Take care
