I was recently arrested on public intoxication charges. I pleaded guilty and got a small fine to pay. When booking me, the officer put my first and last name in the wrong order (last name first and first name last). All the other information associated is the same in the system (I was also fingerprinted during this process). When running background checks on myself with my name in the right order, nothing shows up. I am nonimmigrant visa holder who currently works here in the U.S and would like to travel to my home country for a holiday. When I try to come back into the U.S., I will be fingerprinted at the point of entry and this criminal record (with the wrong name) will probably show up. I am concerned that since the name won't match with my passport, that this may be an issue (but my name is there, just in the wrong order).
I wouldn't expect that a public intox charge would effect your ability to enter the US. It's a simple misdemeanor that can be expunged.
