I was a part of a class action suit in which I was entitled monies for a car accident I was in 2006. I received a portion. In order to receive the other portion I had to fill out W9 form for the IRS. I owe the IRS. Will they tax the remaining portion or will they keep the whole check.
You do not fill out W-9 for the IRS. You fill it out so the person paying you can report to the IRS that you received money that may be taxable. Then it is up to you to determine how to report it on your tax return. It is unlikely the IRS will take your money directly. You should be taking steps now to get back into good standing with the IRS so they don't start taking your stuff.
