Until you file for paternity, she has all the rights to your son and all the decision-making authority over your son and as such may take your son out of state. I therefore urge you to file for paternity right away before she takes him. Alternatively, even if she removes him from the State of Florida, you can still file for paternity and request a return of your son as part of your paternity action, provided that paternity action is filed within 6 months of her move.
