My son was awarded temporary custody almost a year ago. What will happen next? Will it stay as temporary custody or will it turn into permanent custody?
There is case law that says a temporary order automatically defaults into a permanent order after the passage of time and if nothing else happens in court in the meantime. There is no hard line for how much time has to pass but can be any where from 12 to 18 months. Also, certain language in the temporary order may have an effect on how it plays out. It would be best to show your order to an attorney for more specific advice.
