I started probation for an alcohol related misdemeanor, and was drug and alcohol tested 3-4 times a week for one month until now. Now my officer has stopped drug testing but is still alcohol testing me at the same frequency. Can my officer reenact the drug testing or is it done for the rest of my probation?
It depends on your current conditions of probation. If you still have a no drugs/controlled substances condition, and if testing was permitted, your probation officer could re-institute testing at any time. It appears at this point that your probation officer was satisfied that drugs were not an issue that needed continuous monitoring, but that does not mean it could not be readdressed in the future.
