Mother coming home drunk and being drunk around the child or abusive to you are different issues and there is also a conduct component to property division , so I agree with the prior 2 attorneys commenss who recommend your brother meet with a divorce practitioner as soon as possible. The child's safety is paramount and delay is not a wise option from what you state.
