I am in the process of modifying my current child support and I want to know if I get married, will my child support increase due to my fiancé making more money? Also if we file our taxes together will the government take the taxes and pay back child support or will they take just my portion and not my fiancé's.
I agree with my colleague, in the context of child support, it is your obligation to support your child, not your fiancé's. If you follow the injured spouse procedures (there is a specific form required that you should talk to your accountant about -- I am not a CPA), then you can protect the portion of the return attributable to your fiancé. Child support is a parent's financial obligation to his/her child. Your fiance is not the father of your child, therefore I would not worry about child support increasing upon your marriage to him.
