My daughter and I were involved in a major car accident almost two years ago. I had broken bones, back injury and brain injury (with memory loss and my speech was also affected). The personal injury lawyer I hired took advantage of me, denied medical coverage so I did not receive medical attention for my brain and back, and settled my case without my permission. I hired a legal malpractice lawyer who took care of the PI lawyer problem. Now, after almost two years since accident, I'm finally getting a settlement check for medical expenses and pain and suffering. I will be using that money to pay the for my hospital stay, and the couple of other medical providers for my broken bones and beginning of back treatment. With what is left, I intend to finally get medical treatment for my back and brain so that I may hopefully get back to some kind of normal life and be able to get a decent job (used to be school principal, but now I can't run a school now). My husband didn't pay taxes for his business for several years, and since my name is on the tax returns, I too owe these taxes. The IRS has sent us notice of intent to levy our house. Will the IRS take my settlement check?
If the IRS has filed a lien for unpaid taxes, that lien will apply to the proceeds from the settlement of a personal injury case. Since you have a new attorney that you hired to sue the bad attorney, you should discuss this with your new attorney to consider all your legal options.
