Our land lord kept $5,000 of our security deposit. He did not return remaining amount within 21 days. He did not notify me of right to pre-move out inspection (1950.5 f) even when I asked for one. He did not provide all invoices for charges. I have photo evidence of repairs not actually completed that he charged us for. He is holding $2500 for major damage that he will fix later and them send us the rest even though it was pre-existing. He made no comment of this on check out sheet. I have confronted him for invoices and he either doesn't reply or says i'll get them soon. It has been almost 2 months. Can I win back all money that no invoices were provided for within 21 days? Can he legally hold this large sum of money with intent to fix damage? If so, how long? Since he didn't give me my right to pre move out inspection can i fight for it all regardless?
You can certainly proceed in state court against your landlord. No one can tell you how a judge will rule.
