I owe a company $21, they are threatening to take me to small claims court. So I would have to pay legal fees on top.... but, really $21????
Can they? Absolutely... Will they? Probably not. Unless you have some form of contract with them that allows them to collect attorneys fees, they won't be able to get their attorneys fees back from the court. You would be responsible for paying the filing fee of $40, but most likely not their attorneys fees. As a result it almost certainly doesn't make sense for them to do this. However, they are legally entitled to, and if they want to bring you to court to waste your time they can, as long as they have a legal basis to do it. I would ask you the opposite question, is this worth continuing to fight over and risk being dragged into court for $21?
