According to my divorce decree Maintenance to wife will be paid monthly for the duration of the Chapter 13 Bankruptcy plan (five years) beginning Feb. 15th 2011-Feb. 15th 2016. Doesn't state any provisions otherwise. So, if I remarry within this time frame would I lose my alimony payments remaining?Divorce was in State of Indiana
You are going to need to ask an Indiana attorney. Under NV law, unless the decree specifically says otherwise, alimony ends upon remarriage.
Responses are for general information purposes only, and are based on the extremely limited facts given. A consultation with an attorney experienced in the area of law(s) indicated in the question is highly recommended. Information and advice given here should not be relied upon for any final action or decision, as the information is limited by its nature to the question asked and the fact(s) presented in that question. THIS RESPONSE DOES NOT CREATE AN ATTORNEY/CLIENT RELATIONSHIP, particularly considering that the names of the parties are unknown.
In Nevada the answer would be no; but that language would likely never make it into the order. Look at the laws of the state issuing the decree. Talk to a lawyer so you know how to proceed. Best of luck and I hope this helps.
You would need to address the question to a lawyer in the sate that the Decree entered in. In Nevada, absent specific language in the Decree to the contrary, alimony (assuming it not "Lump Sum" in nature) does terminate automatically upon death or remarriage. I strongly suggest you consult with an experienced divorce attorney in the applicable state to review the language of your specific Decree. Hope this helps.
