I was pulled over for expired tags and the officer searched my car because it "smelled like weed". They found a pipe and grinder as well as a large baggie and less than a gram of marijuana.
Prison---highly doubt it.
Jail--doubtful if you have an IA criminal defense attorney, on the facts you posted here.
NOT LEGAL ADVICE, NO ATTORNEY-CLIENT PRIVILEGE CREATED. FOR INFORMATION ONLY. DO NOT RELY ON ANY ADVICE YOU RECEIVE FROM ME OR ANY OTHER ATTORNEY ON THIS FORUM. Legal advice comes after a complete review of the facts and relevant documents and an expressed (written) agreement of representation that forms attorney-client confidentiality. Neither of these two events can occur in this forum. Mr. Rafter is licensed to practice in the Commonwealth of Virginia and the US Federal Courts in Virginia. His answers to any Avvo question are rooted in general legal principles--NOT your specific state laws. There is no implied or actual attorney-client relationship arising from this education exchange. You should speak with an attorney licensed in your state, to whom you have provided all the facts before you take steps that may impact your legal rights. Mr. Rafter is under no obligation to answer subsequent emails or phone calls related to this or any other matter.
These are low-level offenses that wouldn’t carry the potential for prison time.
Prison is not a possibility and jail is highly unlikely. A fine a probation is a likely outcome.
Prison is not a sentencing option for the court for first time simple possession of marijuana. You should have the facts reviewed by an attorney who specializes in drug defense to determine whether the search of your vehicle was lawful. Odor of marijuana, standing alone, may not necessarily provide probable cause to search your vehicle unless the State can first establish that it was detected by a law enforcement officer who is trained to differentiate the odor of marijuana from other substances.
