I was enrolled in a 3 month DUI program, only had 1 class and the exit interview left to go. However, I missed 26 days in a row due to financial hardship and was only allowed 21 days by the program director about 2 weeks ago. I just received a warrant for arrest notice and a bail amount, it also says my personal appearance is require at court.
I know it's my fault and I'm owning up to it, my question is will I go to jail once I show up to court and ask the judge to allow me to reinstate the program since I've paid my fines and only have 1 class to go.
You are welcome to throw yourself at the mercy of the court, but you are taking a big risk, especially if you are talking about an OC judge. Hire a private attorney to take care of this for you.
We can see you posted from Costa Mesa. What court was your case? Costa Mesa PD cases go to Westminster Court and that is a good place to be if this is your first violation of probation. But other cases in that area - like Newport Beach, Laguna Beach, Dana Point, etc - all go to Harbor Court in Newport Beach. That court can be tricky. There are some judges there that you would really want to avoid. Hire an attorney familiar with these courts.
