My I-94 expired, I have a Visa extension pending, they asked for more additional informations, but today I have 179 days day since my I -94 expired. If I leave today without sending anymore additional informations for extension, will I get 3 years interdiction ?
Will my future husband( permanent rezident) be able after marriage to get me here ?
If the extension request for your current status is not approved by USCIS you will be out of status as of the time of the expiration of the FORM I-94. You also will have accumulated unlawful presence which will render you subject to the 3 or 10 year bar when you depart the U.S.
Based on the information that you have provided, if you leave today you will have abandoned your application for an extension of status and will be deemed to have accrued 179 days of unlawful presence, counted from the day on which your I-94 expired. Therefore, you would not be subject to the 3-year bar to admission. Please schedule a consultation with an immigration lawyer immediately for additional information and assistance.
