I was subpoenaed today(march 8th) for a court date(march 20th) regarding an unpaid debt. So I called the debt collector and Post dated a check to settle and pay the debt on march 17th. The debt collector said that if my check clears on the 17th, they will call the courts and reschedule for another day to give the money time to clear in their books, and then call again to cancel the date all together. My question is, will I have another cop come to my house to subpoena me again or will they just expect me to know that it was rescheduled?
Unless you hear it from the Court directly, the date is still on. After the 17th, call the Court yourself to determine if the court date is still set.
You received a summons rather than a subpoena. The attorney should reset the court date. The attorney may send you notice, the court will not. Your best bet other than going to the setting on the 20th is to call the court on the 21st and ask for a new date. If they did not reset it and took a default you have 10 days from default to appeal. At that point you will likely need an attorney.
