i was on a suspended sentence for simple possesion crack cocaine and was told not to get arrested fora yr.;but wasnt required to report to a probation officer.now 3 mos later if been charged again for simple poss crack cocaine/ive completed a drug and alcohol class.6 wk program and have signatures of 12 step mtgs ive attended.wondered what my chances are of avoiding jail time
If you have a suspended sentence and you violate the terms of that agreement, then typically the sentence is automatic. That was the deal when the judge sentenced you. And you HAVE been sentenced already, it's just that the court holds the more severe penalties in abeyance pending your successful completion of the remainder of your sentence. You would have to have extremely favorable circumstances to keep the suspended sentence from being impose, and from the facts in your question, I don't think you can. Good luck!
Probably not that great unless you can beat the new drug charge. However, you do seem to be taking the appropriate steps to increase your chances for success. Continue to go to meetings, get a sponsor, work the steps, and document your progress. You may also want to consider taking very frequent (since cocaine is only detectable for 48 hours) drug screens so show proof of sobriety.
